Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and StoryCheck (“StoryCheck”, “we”, “us”). They include a mandatory arbitration provision and a class-action waiver in Section 11. Please read them carefully.
1. Acceptance of terms
By accessing or using StoryCheck, creating an account, or completing a purchase, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you may not use the service. We may update these Terms at any time; continued use after an update constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use StoryCheck. By using the service you represent that you meet these requirements and that you will use the service only for a lawful, permissible purpose.
3. Acceptable use
You agree to use StoryCheck only for lawful purposes. You may not:
- Use StoryCheck to make decisions about employment, tenancy, credit, insurance eligibility, or any other purpose regulated by the Fair Credit Reporting Act (FCRA) or similar laws.
- Stalk, harass, threaten, defame, or otherwise harm any person.
- Resell, redistribute, scrape, or build a database from reports.
- Violate the privacy or rights of any third party, or use the service in any way that is unlawful, fraudulent, or harmful.
You are solely responsible for how you use any information obtained through StoryCheck and for ensuring that your use complies with all applicable laws.
4. Nature of the service and data accuracy
StoryCheck aggregates information from user-provided inputs, publicly available sources, partner data, and licensed third-party providers. Reports present possible matches and confidence scores, not confirmed facts. The underlying data is provided by third parties and public records and may be incomplete, inaccurate, outdated, or attributed to the wrong person. StoryCheck does not independently verify and does not guarantee the accuracy, completeness, timeliness, or identity ownership of any result. You agree to independently verify any information before relying on it, and you acknowledge that results are provided for informational purposes only. StoryCheck is not a consumer reporting agency, and reports are not consumer reports, under the FCRA.
5. Subscriptions, automatic renewal, and billing
Certain features are offered on a paid subscription basis. When you subscribe, you expressly authorize StoryCheck and its payment processor to charge your payment method for the applicable fees, including on a recurring basis, until you cancel.
- Trial and renewal. A $1 charge covers a 7-day trial. Unless you cancel before the trial ends, your subscription automatically renews and your payment method is charged $29.99 per month, and each month thereafter, until canceled.
- Authorization. By starting a subscription you consent to these recurring charges. This authorization is given at checkout and is separate from any consent to receive emails.
- How to cancel. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period, and you retain access until then.
- Price changes. We may change fees on a going-forward basis with reasonable advance notice. Continued use after the change takes effect constitutes acceptance of the new fees.
- No refunds. Except where required by applicable law, all charges are non-refundable and there are no refunds or credits for partial periods.
6. Disclaimer of warranties
THE SERVICE AND ALL REPORTS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. StoryCheck does not warrant that the service will be uninterrupted, secure, or error-free, or that any result is accurate or current.
7. Limitation of liability
To the maximum extent permitted by law, StoryCheck and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or reputation, arising out of or related to your use of the service. In all cases, StoryCheck's total aggregate liability is limited to the greater of the amount you paid to StoryCheck in the twelve months preceding the claim or one hundred U.S. dollars ($100).
8. Indemnification
You agree to indemnify, defend, and hold harmless StoryCheck and its officers, employees, and suppliers from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use or misuse of the service, your violation of these Terms, or your violation of any law or the rights of any third party.
9. Suspension and termination
We may suspend or terminate your access at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Sections that by their nature should survive termination will survive.
10. Changes to the service
We may modify, suspend, or discontinue any part of the service at any time without liability.
11. Dispute resolution; binding arbitration; class-action waiver
Please read this section carefully. You and StoryCheck agree that any dispute, claim, or controversy arising out of or relating to these Terms or the service will be resolved by final and binding individual arbitration, rather than in court, except that either party may bring an individual claim in small-claims court. You and StoryCheck waive any right to a jury trial and agree that claims may be brought only on an individual basis and not as a plaintiff or class member in any class, collective, or representative proceeding. If any portion of this section is found unenforceable, the remainder will continue to apply.
12. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except that the arbitration provision is governed by the Federal Arbitration Act.
13. Severability and entire agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and StoryCheck regarding the service.
